Alameda Short-Term Rental Ordinance: Who Can Still Airbnb

Alameda is set to give final approval to its first short-term rental rules on October 6. Here is what they mean for ADU owners, duplex owners and anyone buying an Island income property.

File 2026-6313 sits on Tuesday's Alameda City Council consent calendar, the part of the agenda that passes without discussion. It also decides who keeps running an Airbnb on the island.

The Alameda short-term rental ordinance limits new rentals to a host's own primary home, keeps most ADUs out of the nightly market and gives existing hosts 90 days to get a permit. If the council gives it final passage on October 6, 2026, the new Section 30-19 takes effect 30 days later, in early November.

So, can you Airbnb your ADU in Alameda? Only if you live in it, or if you have already been renting out a pre-2017 unit for at least a year.

What the Alameda short-term rental ordinance allows

You can rent nightly where you live, and almost nowhere else. The ordinance recognizes two kinds of stays, both 30 consecutive days or less.

"Home sharing" puts guests in your unit. A "vacation rental" puts them in a different unit on the property you live on. There is no cap on nights, since tying rentals to the host's address does that job, as the Alameda Post explained in its council preview.

Tenants can host only in their own unit, with the landlord's written permission, and a rent-program unit can only be home shared, capped at the allowable rent. Every host needs a permit, a business license, $1 million in liability insurance and a local contact who can show up within 60 minutes of a complaint. Stays still carry the city's 14 percent transient occupancy tax.

The September 15 introduction passed 3-0, with Councilmember Jensen abstaining and Councilmember Boller recused, per the Alameda Post.

If you own an ADU or a duplex

This is the split most owners will miss. A backyard ADU is treated far more strictly than the second unit of a duplex.

Under Alameda's ordinance, a duplex owner who lives on site can rent the other unit nightly, but a backyard ADU is off-limits unless the host lives in it.

An ADU or junior ADU cannot be a short-term rental unless the host lives in it as a primary residence. So the classic setup, owner in the Victorian and guests in the cottage out back, is closed to anyone starting fresh. Flip it, with you in the cottage and guests in the main house, and it fits the vacation-rental rule.

A duplex, triplex or fourplex works the other way. Live in one unit and you can rent one other regular unit nightly. Five or more units, and it is home sharing only. Also excluded: SB 9 units, deed-restricted affordable units, and any property with an Ellis Act eviction in the past five years, which knocks out every unit on the lot.

I think the ADU line is right. California spent a decade clearing the way for backyard units so they would house people, which is why the Planning Board asked staff to separate modern ADUs from older cottages. The cost lands on owners who built a cottage counting on nightly income. That is a real loss. Some will now lease long term, which is the point.

The legacy clause ends at the sale

Existing hosts are protected. Their buyers are not. A host with at least a year of operation before adoption can keep going without living on site, including in an ADU created before 2017.

They still need a permit, and they have to apply during the 90-day amnesty after the ordinance takes effect, which lands around early February 2027 if Tuesday goes as planned. Miss it and the rental stops. A fourth violation means permanent revocation.

And the text is blunt about transfers. The legacy exception "shall not apply to subsequent purchasers."

How to underwrite an Alameda income property now

If you will not live there, underwrite long-term rent only. A listing touting Airbnb history is showing income the next owner cannot legally earn.

Island prices leave little room for hopeful math. Here is each area's latest median next to the scores on Houseberry's Alameda neighborhood rankings.

The East End, the older half of the main island between Park Street and the Fruitvale and High Street bridges, carries a 4.4 amenities score and the walkable Park Street strip visitors book for. Its pre-war two-flats and backyard cottages are where this ordinance rewrites the most spreadsheets. The Alameda citywide median was about $1.42 million in August 2026, on Houseberry's numbers.

Owner-occupant buyers come out fine. Live in one side of a duplex and the other side can still help with the mortgage. The trade-off is becoming an innkeeper on your own lot, on a 60-minute response clock.

Two Alameda votes on Tuesday, one direction

The same October 6 consent calendar carries final passage of the ADU condo ordinance, which we broke down in our guide to selling an Alameda ADU separately. Together they say backyard units are for people who live here, as renters or owners.

Watch whether anyone pulls the item off consent Tuesday. After that, the next checkpoint is the January 2028 staff report on whether units moved back into long-term housing.
